Terms and Conditions for SMS Messaging
Please read these terms carefully before opting in to receive SMS messages
1. Acceptance of Terms
By opting in to receive SMS messages (text messages) from ALL3 Holding Group DBA All3 GROUP ("we", "us", "our"), you agree to be bound by these Terms and Conditions. These terms apply to all SMS communications sent by us, including but not limited to appointment reminders, informational messages, promotional offers, and customer support responses. If you do not agree to these terms, do not opt in or reply STOP to any message.
2. Description of Service
Our SMS service provides you with information related to insurance products, investment opportunities, commercial loan offers, appointment scheduling, and other financial services we offer. Message frequency may vary depending on your interactions and preferences. Standard message and data rates may apply.
3. Opt-In Process
You expressly consent to receive SMS messages from us by: - Submitting a form on our website that includes your mobile phone number and checking the consent box; - Sending a keyword (e.g., START, JOIN, SUBSCRIBE) to our designated short code or long code; - Providing your phone number to one of our agents and indicating you wish to receive text messages. Consent is not a condition of purchasing any goods or services. You may opt out at any time (see Section 5).
4. Message Types and Frequency
You may receive the following types of messages: - Transactional messages: confirmations, appointment reminders, status updates (up to 3 per week). - Marketing messages: product offers, financial tips, educational content (up to 2 per week). - Customer service responses (as needed, typically 1-3 per interaction). Message frequency may increase during active loan applications or insurance policy management. You will never receive more than 10 messages per week.
5. Opt-Out (Stop) Instructions
You may cancel the SMS service at any time. To opt out, simply reply STOP to any message you receive from us. After you send STOP, we will send one final confirmation message and no further messages will be sent to your number. 7. Carriers Supported
Our SMS service is supported by major US mobile carriers including but not limited to AT&T, Verizon Wireless, T-Mobile, Sprint, MetroPCS, U.S. Cellular, and others. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier network conditions.
8. Fees and Charges
ALL3 Holding Group DBA All3 GROUP does not charge you for sending or receiving SMS messages. However, standard message and data rates from your mobile carrier may apply. Please check with your carrier for details. You are responsible for any fees incurred.
9. Privacy and Data Protection
Your privacy is important to us. We collect and use your mobile phone number and message history only to provide the SMS service. We do not sell or rent your information to third parties. For more details, please review our Privacy Policy.
10. Limitation of Liability
To the fullest extent permitted by law, ALL3 Holding Group DBA All3 GROUP and its affiliates, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the SMS service, including but not limited to delayed or undelivered messages, carrier errors, or unauthorized access to your data. Your sole remedy is to discontinue use of the SMS service.
11. Indemnification
You agree to indemnify, defend, and hold harmless ALL3 Holding Group DBA All3 GROUP from any claims, damages, losses, or expenses (including reasonable attorney fees) arising out of your violation of these terms, misuse of the SMS service, or violation of any applicable law or third-party rights.
12. Modification of Terms
We reserve the right to change these Terms and Conditions at any time. Material changes will be communicated via SMS or email where possible, and the effective date will be updated. Continued use of the SMS service after changes constitutes your acceptance of the revised terms. If you do not agree to the new terms, you may opt out by replying STOP.
13. Termination of Service
We may suspend or terminate your participation in the SMS service at any time, without notice, for any reason, including violation of these terms or as required by law. You may also terminate by replying STOP.
14. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of laws principles. Any legal action arising from these terms shall be brought exclusively in the state or federal courts located in Bergen County, New Jersey.
